Decentralisatie en beheer van competentie conflicten in de Democratische Republiek Congo Decentralization and management of competence conflicts in Democratic Republic of Congo

Decentralization is enshrined in the Constitution of the Democratic Republic of Congo from 18 February 2006, as amended by Act No.
11/002 of 20 January 2011 as a state managed. The Constitution gives more autonomy and powers to local authorities. The implementation of the decentralization reform raises conflicts(of jurisdictions) between the central power, the Provinces and decentralized territorial entities comprising Cities, Towns, States and Chiefdoms that are not subject to constitutional and administrative courts.

This study therefore aims at understanding the reasons for conflict(s) of jurisdiction(s), it proposes possible solutions to remedy the
weakness of decentralization, and analyzes the impact of constitutional and administrative justice in steering the decentralization reform in the Democratic Republic of Congo.
