Verwijtbare betrokkenheid van advocaten bij criminaliteit: strafbaarheid, strafonderzoek en waarborgen tegen misbruik" "Frank Verbruggen" "Instituut voor Strafrecht" "Ze doken al op in zowat elke maffiafictie: de advocaten die zo dicht bij de leden van criminele organisaties staan, dat de vraag rijst of ze zelf geen strafbare gedragingen stellen. Tijdens de voorbije jaren kwamen in Belgische en Nederlandse realiteit er echter ook verscheidene opzienbarende strafprocedures tegen advocaten die van hun professionele positie misbruik zouden hebben gemaakt in opdracht of minstens in het belang van criminele organisaties. De problematiek speelde in het verleden in een aantal Europese landen ook al bij processen tegen terroristische organisaties. Daar vond de overheid dat de advocaten, die niet zelden de ideologie van de verdachten en beklaagden deelden, hun positie gebruikten om de ‘normale’ strafprocedure te verstoren. Of misschien nog erger, dat ze de belangen van de organisatie behartigen, veeleer dan die van hun individuele cliënt, die er net belang bij kon hebben zich tegen de organisatie zou kunnen keren. Bovendien neemt het strafbeleid sleutelpersonen met een brugfunctie tussen criminele organisaties en de zgn. bovenwereld in het vizier en advocaten maken daar, net zoals financiële tussenpersonen of notarissen , deel van uit. Advocaten zitten per definitie in een moeilijke positie: ze moeten immers de belangen van hun cliënten behartigen, niet zelden van cliënten die zelf onrechtmatig hebben gehandeld. Om dat zinvol te kunnen doen, genieten advocaten een aantal voorrechten, zoals toegang tot de cliënt ook op momenten en plaatsen waarop anderen dat niet hebben en een stevig verankerd beroepsgeheim. Daarbij is het uitermate belangrijk dat de advocaat weliswaar zijn cliënt in procedures bijstaat en vertegenwoordigt, maar dat het fout en ronduit gevaarlijk is de advocaat als juridische dienstverlener te veel met zijn cliënten te vereenzelvigen. Dat betekent anderzijds ook dat de advocaat zich op glad ijs begeeft als professionele en persoonlijke relaties onvoldoende te onderscheiden vallen. Net vanwege hun bevoorrechte positie vormen advocaten immers een interessant doelwit: van criminele organisaties die via geld of bedreiging bv. toegang tot personen of dossiers willen bekomen of in het geheim willen communiceren. Doch ook van de overheid: een advocaat die zelf wordt beschuldigd, kan zijn cliënt niet langer bijstaan en daarenboven verlenen zoekingen of beslagen bij advocaten toegang tot informatie die normalerwijze geheim zou blijven. Als de advocaat zich verdacht wordt, verdwijnt immers ook (een deel van) zijn beroepsgeheim. Het eerste luik van het onderzoek bekijkt het probleem vanuit het materieel strafrecht. Want ruime strafbaarstellingen zorgen er voor dat zowat elke activiteit die een criminele organisatie of haar leden begunstigt, ook een op zich legale handeling, onder de strafwet valt. Daarom zal er ruimte moeten bestaan voor rechtvaardigende werking van ‘noodzakelijke’ advocatenhandelingen en de moeilijke bepaling van de gevallen waar de advocaat ‘te ver gaat’ en zich aan strafbaar gedrag schuldig maakt. Na het theoretisch kader van de strafbaarheid en de rechten van advocaten en hun cliënten uiteen te hebben gezet, zullen zo veel mogelijk echte strafdossiers en persberichten worden bestudeerd om te kijken welke precieze gedragingen dan wel of niet als verwijtbaar werden beschouwd. Daarbij zal een onderscheid worden gemaakt tussen de advocaten in het kader van (straf)procedures en andere activiteiten, zoals bijstand of advies bij het opzetten van financiële of fiscale constructies. Het tweede luik van onderzoek focust op de extra waarborgen die zich in de strafprocedure opdringen als in het onderzoek of bij de bewijsgaring bewust of indirect een advocaat wordt geviseerd. Op het Europees vlak zowel als bij het Grondwettelijk Hof heeft deze materie de voorbije jaren extra aandacht gekregen en het valt te betwijfelen of het huidige Belgische kader – waarbij de wetgever opmerkelijk veel aan rechtspraak en (verdeelde) rechtsleer heeft overgelaten- wel voldoet. Daarbij gaat het over advocatuur van de eenentwintigste eeuw, d.w.z. minder individueel en kantoor- of ‘paleisgebonden’ dan in de negentiende of twintigste eeuw en steeds meer gedigitaliseerd. Bovendien lijkt in die moderne en digitale context een eenvormig normatief kader ook voor grensoverschrijdende situaties nodig, dus duidelijke en bij voorkeur zelfs Europese standaarden. Daarbij zullen ook tot nu toe weinig bestudeerde kwesties aandacht krijgen, zoals de vraag of het openbaar ministerie een advocaat het statuut van spijtoptant mag aanbieden en of die dan tegen zijn ex-cliënten mag getuigen en zo ja, onder welke voorwaarden dan wel. In het laatste deel wordt bekeken welke rol de beroepsorganisaties van advocaten kunnen spelen in de bescherming van de conflicterende belangen: niet alleen die van de advocaat, maar ook die van zijn cliënten en het algemeen belang. Daarbij worden niet alleen juridische, maar ook praktische en technologische oplossingen bekeken. Kan de advocatuur een eigen exclusief systeem van cryptocommunicatie krijgen en kan de beroepsorganisatie advocaten dan verplichten dat te gebruiken voor professionele communicatie? Dreigt een te grote rol voor die beroepsorganisatie en de centralisering van een versterkt toezicht op deze vrije beroepers de onafhankelijkheid van de individuele advocaat in gevaar te brengen, zeker als de overheid die beroepsorganisatie of de leiding ervan in haar greep zou krijgen? Europese initiatieven om de onafhankelijkheid van de magistratuur binnen de rechtsstaat te beschermen, kunnen inspiratie bieden, maar zullen moeten worden herbekeken in het licht van de specifieke positie en rol van advocaten." In this process, the adaptation of the privilege against self-incrimination has proven particularly challenging. While it is uncontested that no one can be forced (directly or indirectly) to admit their guilt, the extent of the privilege beyond self-accusatory statements is a contentious matter. The compliance of mandatory duties of cooperation and the extent of the right to silence are of special relevance in administrative proceedings. Also, the possibility to punish (and the definition of punishment) of non- cooperative behaviors of the defendant are a matter of heated debate. The CJEU’s most recent case law has innovated the traditional cautious approach expanding both the scope and the content of the privilege, potentially revolutionizing the legitimacy of European administrative investigations and proceedings. This project intends to contribute to the clarification of the scope of the nemo tenetur in OLAF investigation in light of the most recent CJEU case law, as OLAF represents the modern hybrid crime-repression strategy sitting between administrative and criminal law. Considering OLAF’s multifaceted duties and the different purposes of its reports (civil, administrative, criminal) it is fundamental to unpack the structure of the privilege and understand its applicability and form in each case. On the basis of this research, this project wants to develop guidelines on the application of the nemo tenetur and to offer interactive practice-oriented training to OLAF officials and AFCOS. The system will provide tools to generate new characters and new scenarios easily. "Heidi Salaets" "Onderzoeksgroep Tolkwetenschap, Campus Antwerpen" "The ChiLLS research project will investigate the interpreter-mediated questioning of minors who come into contact with the police or with other legal actors in the context of criminal proceedings. ChiLLS is a continuation of the CO-MINOR-IN/QUEST I and CO-MINOR-IN/QUEST II research projects. The ChiLLS research project wishes to take the above mentioned research a step further. The researchers will conduct interviews and focus groups with minors who are or were involved in a criminal investigation. Furthermore, the researchers will focus on highly vulnerable minors. This means that the minors are not only vulnerable because of their age or their mother tongue but also because of some physical, hearing, visual or mental impairment. The aim of the research project is to inform highly vulnerable minors about how/where they can get help if they do not speak the same language as that of the investigation. To reach that aim, the researchers will develop posters, leaflets and other educative materials.The goal of this research is to inform the legal actors, including juvenile court judges and youth counsellors, but also police officers and lawyers, psychologists and social workers, about how to deal with highly vulnerable minors who do not speak the language of the proceedings. The main focus will be on detecting impairment and taking into account the influence such impairment can have on the communicative situation involving the minor. All this information will be brought together on a website: in that way, the experts involved can very easily search for and find information about important factors to take into account when conducting interpreter-mediated interviews with highly vulnerable minors. Toolkits and a compass will also be made available on the website to allow those involved to quickly detect problems in the target group. Furthermore, the stake holders can get in touch with each other through a secured communication platform on the same website. In that way, real multi-disciplinarity can be achieved." "Silvia Allegrezza, Frank Verbruggen" "Instituut voor Strafrecht" "Cybercriminaliteit neemt toe en conventionele onderzoeksmaatregelen zijn bijna onbruikbaar tegen de methoden van anonimisering en encryptie die worden gebruikt door cybercriminelen. Legaliseren van 'hacking' voor politieonderzoeken zou een deel van de oplossing kunnen zijn om deze obstakels te overwinnen. Police-hacking omvat een aantal bestaande onderzoeksmaatregelen waarbij onderzoekers op afstand toegang krijgen tot een apparaat door malware te gebruiken. Deze praktijk brengt echter belangrijke juridische tekortkomingen met zich mee, vooral met betrekking tot inbreuken op de grondrechten. Daarom is een juridisch kader nodig dat voorziet in specifieke regels inzake evenredigheid en rechterlijke toetsing om ervoor te zorgen dat de grondrechten en nationale grondwettelijke waarborgen volledig worden geëerbiedigd, zonder grensoverschrijdende samenwerking tussen EU- en internationale wetshandhavingsinstanties te omvatten. "Naar operationele samenwerking bij lokaal administratief financiele onderzoeken in de strijd tegen mensenhandel" "Dirk Van Daele" "Instituut voor Strafrecht" "Local city government is confronted with indications of human trafficking:in the hotel and catering industry (cafés, bars, private clubs), massage salons, establishments for sexual activities, buildings for (window) prostitution, , - (= sexual exploitation)in hand-carwashes, night-shops, betting centers, housing foreign workers (= economic exploitation)in the public domain (= begging)These indications are apparent in reports concerning the disturbance of public peace (bothersome and irritant behaviour, overpopulation, rent of mattrasses, illegal employees and (possible covert) forms of prostitution). These indications are reported by neighbourhood workers, police forces, civilians and city administrations.Some of these establishments are subjected to an obligatory permit by local aministration, as a result of which several checks are performed (compliance with building regulations, integrity of the applicant, financial situation of the business, ... ) However, the financial screening is limited and often fails to identify criminal activities which could lead to a refusal of the permit. As a result, human traffickers are able to use legal economy to facilitate and sustain their criminal activities, sometimes even supported by government subsidies.A thorough financial screening could provide clues of human trafficking, both during the screening process of the requested permit, as during the business operation. This also includes a thorough scrutiny of the legal forms of company, assets and deposit money flows. Reports of bothersome and irritant behaviour or slumlords might not be related to human trafficking on first sight, but broader screening could reveal clear links.This project proposal aims to organise a financial screening of the different sectors mentionend above. Said screening would focus on financial criteria that seem to point to human trafficking. As such, human traffickers are denied the opportunity to develop their illegal practices. At the very least human trafficking could be detected and stopped in very early stages. "Rechtspsychologische studies naar seksueel misbruik van kinderen in Indonesië: de rol van forensische interviews bij kinderen" "Henry Otgaar" "Leuvens Instituut voor Criminologie" "Het verhogen van succesvolle vervolgingspercentages in gevallen van seksueel misbruik van kinderen (CSA) is een belangrijk doel van wetshandhavingsinstanties om de veiligheid van kinderen te waarborgen. Onderzoek heeft echter aangetoond dat de juridische vervolging van CSA-zaken zeer complex is, met als gevolg dat slechts een klein percentage van de zaken wordt vervolgd en uiteindelijk voor de rechter wordt bewezen. Vaak hangt het bewijsmateriaal in CSA-gevallen af van de getuigenis van het kind, omdat verdachten in CSA-gevallen vaak ontkenning zijn en omdat forensisch technisch bewijs ontbreekt. In het huidige onderzoeksproject zullen we verschillende onderzoeken uitvoeren die betrekking hebben op verschillende aspecten met betrekking tot CSA (bijvoorbeeld het interviewen van slachtoffers van misbruik). De eerste studie onderzoekt het verband tussen CSA-casuskenmerken en CSA-vervolging en strafrechtelijke uitkomsten door middel van een archiefonderzoek in twee politiedistricten in Groot-Jakarta, Indonesië. In deze archiefstudie wordt onderzocht welke factoren, zoals gevonden in politiedossiers, de resultaten van het strafrecht voorspellen. In een tweede onderzoek zullen we het NICHD evidence-based forensisch kind-interviewprotocol op twee politiebureaus in Jakarta implementeren. Het doel van deze tweede studie is het verbeteren van methoden voor het interviewen van kinderen door politieagenten. Het klassieke dogmatisch en politiek misschien handige status-quo is om verschillende redenen verstoord geraakt: de mensenrechten zijn uitdrukkelijk doorgetrokken naar de fase van de strafuitvoering; politie en parket leggen er zich steeds minder bij neer dat een ontvluchte veroordeelde ongemoeid wordt gelaten tot de verjaring van de straf intreedt; en de overheid beseft steeds meer dat ze een categorie gevaarlijke veroordeelden noch tijdens de strafuitvoering, noch daarna, uit het oog mag verliezen. Wij moeten dus op zoek naar een nieuw evenwicht. Het doel van het onderzoek is het vastleggen van algemene beginselen als basis voor een wettelijk kader voor indringende onderzoeks-bevoegdheden in de fases van de straftoemeting en de strafuitvoering, in het licht van de regeling van vergelijkbare bevoegdheden in de fase vóór de veroordeling. Verder zal worden nagegaan of een verregaande integratie van deze regimes mogelijk en wenselijk is."
