In this contribution, the author makes some comments on the decision of the Supreme Court of 29 May 2020 regarding the escape-clause of Article 8, 4 of the Rome 1 Regulation, as well as on the opinion given by the Advocate General at the Supreme Court, in the light of previous case law including Supreme Court 23 November 2018, Court of Justice of the European Union Schlecker (C-64/12) and Court of Justice of the European Union Nogueira (C-168/16 and C-169/16) as well as the pending FNV-Case C-815/18 in which an opinion has already been delivered by the Advocate General at the Court.
