Traditional property law can sometimes be useful to combat environmental problems such as pollution. The remedies concerning excessive nuisances (neighbourhood disturbances; burenhinder/troubles de voisinage) are an example hereof. In this article, I analyse the usefulness of excessive nuisance law to protect the environment, concluding that it has some utility, but that it has been reduced by certain policy decisions.
