Improving the European Regulatory Framework for Centrally Cleared Financial Derivatives: A Legal Analysis Based on Economic Substance Ghent University
Through the examination of alternative risk mitigating mechanisms, the proposed research project aims to explore the legal design of a regulatory framework for centrally cleared financial derivatives which not only exploits the advantages of a central clearing mandate, but also addresses the potential costs, risks, and distorted incentives thereof.
