Economically
analyzed, time has a certainvalue. Therefore it is often essential for
contract parties to define the start and end of their obligations. By using a
suspensive time stipulation parties can deviate from the principle of immediate
exigibility of the obligation, while an extinctive time stipulationsets down
how long they are obliged to perform.

Despite the
apparent simplicity, the use of time stipulations can lead to many
uncertainties. These problems are reinforced by the deficiency of an accurate
legal regime. Innovative research is essential and can be split up into four
parts. Firstly, the wide spread definition of the time stipulation is examined.
Secondly, the limitations of the choice of the parties is investigated. Then
the question whether a time stipulation modulates the obligation or the legal
act on its whole needs an answer. Finally, the interchangeability between the
suspensive and extinctive time stipulation will be examined.
