Testing legitimacy and proportionality of patrimonial protection of vulnerable adults: a comparative legal study on administration and enduring powers of attorney.

This project examines how society may protect vulnerable adults, who are unable to administer their estate, without unnecessary or excessive infringing upon their autonomy. The research will identify norms and standards, and implementation thereof, in order to create a fair balance between the fundamental autonomy of any adult and the exceptional need for protection. One objective is a critical evaluation of the Belgian rules on administration of property of adults, through a comparative legal research of several systems of such administration. The main focus is on the issue whether models with an Enduring Powers of Attorney-approach, and merely a last resort jurdicial administration model, are more adequate to guarantee the vulnerable adult's autonomy and create a balanced system of protecting their estate.
