An empirical law and economics analysis of director's liability case law (R-13402)

Well-functioning courts (particularly those handling commercial disputes) are a pivotal institutional condition for economic performance. For that reason, court decisions have increasingly become the subject of empirical scrutiny among both lawyers and economists. Although judgments should be based on legal merit, research has shown that extralegal factors play a role as well. The aim of this project is to analyze whether discrepancies exist in judicial decisions of commercial cases in Belgium, a so far un(der)explored case law. More specifically, we will explore and analyze a completely new and unique dataset consisting of all judgments by the commercial court of Antwerp and the Antwerp Court of Appeal on director's liability.
