Divison of competences between the EU, its member states and subnational entities as regards services of general interest and its impact on EU competition law.

This academic research project focuses on the division of competences between the EU and its Member States, with special attention to state aid related cases in the domain of port management. The research aims at clarifying the precise contours of the discretionary competences of EU Member States (and their subnational regulatory entities) in the domain of services of (non-economic) general interest. This analysis will give due weight to the TFEU and Protocol nr.26 and contribute to a better understanding of the interaction between the European Commission's exclusive competence in the field of competition and the genuine options of Member States to organise certain activities within the realm of their prerogative powers. The research findings will be applied on models of port infrastructure management.
