State obligations regarding online gender-based violence

Subtitle:A moving puzzle
Online gender-based violence is currently a major societal challenge, and has been so already for years. The European Court of Human Rights (ECtHR) has acknowledged this fact, but it is only progressively – and arguably slowly – throwing light on the obligations incumbent on states in this area, notably by emphasizing the connections between cyber-violence and domestic violence. This chapter examines the emerging ECtHR case law in this field, questioning notably whether the focus on the connection with domestic violence offers the best framing for moving forward human rights protection against online gender-based violence.
